Allahabad High Court Allows Petitioner to Seek Protection While Surrendering Before CJM

The Allahabad High Court has disposed of a Criminal Miscellaneous Writ Petition filed by petitioner Anubhav Shukla against the State of Uttar Pradesh and four others. The matter was heard by a Division Bench comprising Hon’ble Justice Siddhartha Varma and Hon’ble Justice Madan Pal Singh.


The petitioner was represented by Advocate Kumar Anubhav. He raised concerns about the threat to his life following the registration of an FIR dated 15.03.2024. According to the petitioner, he feared that during the investigation, the police might cause him harm, potentially even resulting in his death.

He alleged that while the FIR was initially registered under Sections 363 and 366 of the IPC, more serious charges, including Sections 376 IPC and 3/4 of the POCSO Act, were later added to intensify the case against him.


The Court opined that if the petitioner genuinely apprehends any danger to his life, he is at liberty to appear before the Chief Judicial Magistrate, Prayagraj, and seek protection at the time of his surrender.


With these observations, the Court disposed of the writ petition. The order was passed in the presence of Sri Ajay Shama, learned Additional Government Advocate (AGA), and Sri K. Shahi, counsel for respondent no. 2.
